Fundación Banco Popular (“Fundación BP,” “We,” “Us”) owns and operates the website fundacionbancopopular.org (“Site”). Fundación BP reserves the right to change or modify any of the provisions contained in these Terms or any policy or guideline of the Site, at any time and in our sole discretion.  Any changes or modifications to these Terms will become effective upon their availability on the Site, and you waive any right you may have to receive specific notice of such changes or modifications.  Your continued use of the Site will confirm your acceptance of any changes or modifications to these Terms.  Therefore, you should regularly review these Terms to be informed of the rules that apply to your use of the Site.  If you do not agree to the amended terms, you must stop using the Site. 

Unless stated otherwise, all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Content, contained on the Site is owned, controlled or licensed by or to Fundación BP and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws. FUNDACIÓN BP DOES NOT PROMISE THAT THE SITE OR ANY CONTENT, SERVICE OR FEATURE OF THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE SITE WILL PROVIDE SPECIFIC RESULTS. Fundación BP reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Site, or any portion of the Site, for any reason; (2) to modify or change the Site, or any portion of the Site, and any applicable policies or terms; and (3) to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

Except where prohibited by law, in no event will Fundación BP be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if Fundación BP has been advised of the possibility of such damages.

Any dispute rising from these Terms of Use, shall be construed and enforced in accordance with the laws of the Commonwealth of Puerto Rico without regard to the principles of conflicts of law.  You acknowledge and agree that the courts of the Commonwealth of Puerto Rico shall have exclusive jurisdiction over any and all such disputes.

Notwithstanding any of the Site’s Terms, Fundación BP reserves the right, without notice and in its sole discretion, to terminate your license to use the Site, and to block or prevent future your access to and use of the Sites.

If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
